At Duron Equipment Inc., your privacy is very important to us. The Duron Equipment Inc. Customer Privacy Code informs you of personal information that we collect, and how we may use and disclose this information. It provides information about your privacy rights along with our general rights and obligations. It also contains information about your options in the event you don’t want us using or disclosing your personal information for certain purposes in the future.

What Kinds of Information We Collect

The types of personal information we ask for will depend on the type of product or service you request. Generally, the types of information that we collect consists of the following:

  • General Information: your name, current address, phone/fax numbers, email addresses, and records of parts, service, and/or equipment which you have purchased from us.
  • Additionally, if you apply for credit or have a credit relationship with us, we will have information regarding your current and historical account information with us, your financial statement information (including income), social insurance number (on an optional basis, however if not included, it may affect the outcome of your credit application), date of birth, the equipment you purchased (if applicable), and the dollar amount being financed.
  • If you apply for credit from us, we also collect credit information about you and may obtain property reports about any property which secures your obligation to us.
  • If we assist you in financing equipment, information about what is being financed, insured, proof of insurance, and your income and occupation.
  • Telematics: Equipment may include telematics hardware and software (“Telematics”) that transmit data to Bobcat, and which certain Duron Equipment Inc. staff may have access to. How We Collect Your Information

When you purchase a product or a service, or provide information to register for a product warranty, we collect personal information about you such as your name, mailing address, phone/ fax numbers, and product ownership information. Additionally, when you purchase or lease goods or services on credit, we generally, with your consent, collect personal information about you from yourself, credit bureaus, financial institutions, and other creditors, your employer, and publicly available sources. For example, when you apply for credit through the various creditors we offer, we would have you fill out an application where you would provide them with financial information that would be used to determine your eligibility for credit by reviewing your credit rating, calling your references, and confirming your financial information such as annual income, etc.

In the course of serving you, we may have also collected information such as the name of your insurance company/agent(s), your date of birth (and possibly birthdays of other members of your family), as well as information related to your various credit accounts.

How We Obtain Your Consent To Collect Your Information

When you purchase or lease goods or services on credit, the credit applications include notices in regards to privacy and requests your informed consent to use the personal information for the purposes stated on the application form. The credit application specifies the purposes for which your personal information may be collected, used, or disclosed. Your consent to some of these purposes is required to complete the credit transaction, and without your consent to some of these purposes your application cannot be processed. Other purposes are not mandatory, and you may elect to withhold consent to the use of your personal information for these purposes (see “Promotional Opt Out” below).

How We May Use Your Personal Information

We may use your personal information from time to time for the following purposes:

  • To provide you with the product or service you requested
  • To identify your product ownership or use, or your entitlement to a service
  • To send you necessary information such as warranty information, product improvement programs, safety bulletins, or recall notices
  • To assess your creditworthiness
  • To extend credit to you
  • To service and collect your account
  • To initiate, maintain, and develop our business relationship with you relating to offering and servicing of products, services, and credit
  • To establish your eligibility for special offers and discounts
  • To monitor your purchasing history so we can understand your preferences for products and services
  • To comply with applicable law
  • For promotional purposes, for which we may use (but will not disclose) your personal information to promote and market additional goods, services, and special offers from Duron, our creditors, and related equipment suppliers. Examples of these materials include company magazines, catalogues, product videos, brochures, invitations to special events, special offers, and parts and service announcements. You have the option of withholding your consent to the use of your personal information for our promotional purposes.

We will not disclose any of your personal information to suppliers to be used for promotional purposes without your consent (this includes your sensitive financial information).

What Rights Do We Have to Disclose Personal Information

In carrying out the purposes listed above, we may disclose your personal information to suppliers and manufacturers (such as Bobcat Company, etc). For example, if you purchased equipment manufactured by Bobcat, we would disclose information relevant for warranty registration to Bobcat so that they would be able to send you materials relating to your ownership of the equipment (warranty, product improvement notices, etc.).

If you have applied for credit through us, in assessing your creditworthiness and extending credit to you, we may disclose and collect your personal information to and from credit reporting agencies, credit bureaus, financial institutions, your employer, and other creditors and entities that you have identified on your credit application form.

We do not sell your information to third parties

As described above, with your consent, Duron may disclose your personal information to Bobcat to receive promotional materials, and to extend special offers to you. You may elect not to receive such promotional materials (see “Promotional Opt Out” below). If you have previously opted out, you may at any time change your mind and opt back in and consent to our disclosure of your personal information to Bobcat so they can promote and market additional goods, services, and special offers to you. At your option, you may also elect to consent to our disclosure of personal financial information to third party financial institutions who have requested credit references about you. You must grant your consent if you wish to allow us to provide credit references about you. Consent may be communicated by writing (or faxing/e-mailing) us to let us know that you want to use us as a credit reference. If a request from you is not received and a third party calls due to us being listed as a credit reference, we will request a copy of your signed authorization using us as a reference, or we will contact you to confirm your consent and have you send us a written copy.

Additionally, we will disclose your personal information if we are required to do so or if the law allows us to do so. For example, we may have reporting requirements to the Canada Customs and Revenue Agency that may include your personal information, or we may be required to give your account or finance details to a court if we are ordered to do so.

Lastly, we reserve the right to disclose and/or transfer personal information to a third party in the event of a proposed or actual purchase, sale, lease, merger or amalgamation or any other type of acquisition, disposal, or financing of all or any portion of our businesses for you to continue to receive the same products and services from such third party.

We may at other times give you more details about our disclosure practices in relation to specific products or services on the forms we use to collect your personal information. At that time we will seek your consent as appropriate.

How We Protect The Security of Your Information

We use every reasonable effort to protect your personal information from misuse, loss, unauthorized access, modification, or disclosure. We have physical, electronic, and procedural safeguards to protect your personal information. For example, your sensitive personal information is stored in secured office premises and/or in electronic databases requiring logins and passwords for access. Access to information stored electronically is limited to staff whose job purposes require access to that information. We require all staff to maintain the confidentiality of customer information and we will have training programs in place to educate staff about our privacy policies and practices.

How Long We Retain Your Information

We will retain your information for only as long as required to fulfill the identified purposes for which your information was collected and as long as required to provide you with the services you may require. We also comply to any legal requirements or obligations we have under legislation relating to the amount of time that we must retain your personal information.

What Are Your Rights?

You do not have any obligation to provide us with any personal information, which we may request in our transactions with you. However, certain personal information may be required to provide you with a product or service, process an application, provide you with credit, or to provide you with an appropriate level of service. It is necessary for us to retain some of your personal information if you wish to do business with us.

Promotional Opt-Out

If you do not want the benefit of receiving promotional materials or special offers, then please let us know. You can opt out at any time whether it is at the time your information is collected or afterwards. Access To Your Information

At any time, you can request access to the personal information in your file. We will process your request within a reasonable time, usually 30 days for a straightforward request. More time may be needed, depending on the nature and details of your request. There is no fee for requesting access to your personal information, however we may charge you the reasonable cost of processing and producing the results of your request (e.g., photocopying costs, and depending on the extent of your request, administrative costs.) If we refuse you access to your personal information, we will tell you the reason why.

Correction of Information

We try to ensure that information that we collect, use, and disclose is accurate, complete, and up to date. If you are aware of any information that we have about you is not complete, or accurate, you may notify us and request a correction. Further, we will also notify organizations to whom we have disclosed such information of the correction as required by applicable law.
